Plain English summary: Clare is a research tool, not a doctor — our position is that it is not a health information custodian under Ontario's PHIPA, and that your questions are handled under Canada's federal PIPEDA; this characterisation is our proposed legal position and is under review by counsel. Use Clare to learn, not to replace professional medical advice. When you accept these Terms, we record your acceptance including your IP address; that record is kept for legal accountability purposes and survives account deletion. Each question you ask is archived for 24 months for answer provenance and legal accountability — including questions that contain health information about your child. Credits are non-refundable once used.
These Terms of Use ("Terms") govern your use of Clare, operated by JQuant Labs ("we", "us", "our"). By creating an account or using Clare, you agree to these Terms. If you do not agree, please do not use the service.
Clare is a research tool that helps parents find information from peer-reviewed studies and published guidelines. Clare is not a medical service and does not provide medical advice, diagnosis, or treatment.
Our position is that Clare is not a health information custodian as that term is defined under Ontario's Personal Health Information Protection Act (PHIPA), and that Clare operates as a consumer information tool under Canada's federal Personal Information Protection and Electronic Documents Act (PIPEDA). This is our proposed legal characterisation; it is under review by counsel and may be updated. Questions you ask Clare may include personal health information about your child — for example, symptoms, medications, growth measurements, or developmental concerns. That information is stored and handled as personal information under PIPEDA. If you have questions about what this means for your situation, contact us at hello@askclare.ca.
Clare's answers are based on published research and are intended for informational purposes only. You should always consult a qualified healthcare professional — such as your child's doctor or a registered nurse — for any health concerns about your child. In an emergency, call 911 or your local emergency number immediately.
Clare is designed for use by parents and caregivers. Although Clare collects information about children from their parents or caregivers — not directly from children — parents and caregivers in the United States should be aware that information entered about their child is subject to the privacy framework described in our Privacy Policy, including additional disclosures applicable to US residents in Section 9 of that policy.
You must be at least 18 years old to use Clare. By using Clare, you confirm that you are an adult and are using the service on your own behalf or as a caregiver for a minor in your care.
You are responsible for maintaining the security of your sign-in link and session. Do not share your account with others. We reserve the right to suspend or terminate accounts that violate these Terms.
You may delete your account and all associated data at any time directly within the app (Account → Delete Account), or by emailing hello@askclare.ca. See our Privacy Policy — particularly Section 11 — for details on what data is retained after deletion and why.
When you accept these Terms or our Privacy Policy, we record your acceptance as required under PIPEDA to demonstrate that meaningful, informed consent was obtained. That record contains: which version of the Terms or Privacy Policy you accepted, the date and time of acceptance, and the IP address from which you accepted. The IP address is retained solely to establish that consent was given from a plausible location at the recorded time — it is never used for tracking, advertising, or profiling.
This consent record is retained for the life of your account and for a period after account deletion sufficient to demonstrate, to a regulator or court, that consent was properly obtained under PIPEDA. Deleting your account does not immediately erase your consent record. If you do not wish us to retain this record, do not create an account or use Clare.
Every question you ask Clare and Clare's response — including the research sources cited — is archived for a period of 24 months from the date of that interaction. This archive serves as a legal accountability measure, allowing us to verify the accuracy and provenance of answers in the event of a complaint, regulatory inquiry, or legal proceeding. The appropriate retention period is subject to legal review. Questions may contain personal health information about your child — for example, symptoms you described or medications you mentioned. That content is subject to the same 24-month retention.
After 24 months, each archived interaction is automatically and permanently deleted by a scheduled process. If you delete your account before an interaction's 24-month window has elapsed, the archived record of that interaction remains in encrypted storage until its scheduled deletion date. The archive record does not contain your name or email address, though it may be linked to a pseudonymous account identifier. It is stored with encryption and randomised, unguessable storage keys, is accessible only to authorised Clare systems, and is never used for advertising or sold to third parties.
Credits are consumed based on the complexity of each response. Longer, more research-intensive answers consume more credits than brief responses. The credit cost is shown after each answer.
Refund policy: Credits that have already been consumed are non-refundable. If you experience a technical issue that incorrectly consumed credits, contact us at hello@askclare.ca and we will review your case.
If you purchase credits or a subscription through the Clare iOS app, that purchase is processed by Apple as an In-App Purchase — not by Stripe — and is billed to the payment method associated with your Apple ID.
Subscriptions purchased this way automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the price shown at time of purchase unless changed with notice. You can view, manage, or cancel your subscription at any time in your device's Settings → [your name] → Subscriptions.
Because Apple processes these payments directly, only Apple can issue refunds for App Store purchases — JQuant Labs has no ability to refund an In-App Purchase on Apple's behalf. To request a refund for a purchase made through the App Store, use Apple's own process at reportaproblem.apple.com.
Clare may be gifted to another person by entering their email address at time of purchase — no code is generated or shared. Gift purchases are a one-time payment and do not create, renew, or modify a subscription for the buyer; the buyer's own plan is unaffected.
If the recipient's email is already associated with a Clare account, the gifted credits are applied immediately. If not, the gift is held for 30 days and applied automatically the moment someone signs up with that exact email address. If the gift is unclaimed after 30 days, it expires and is forfeited; JQuant Labs is not obligated to reissue or refund an expired, unclaimed gift.
Gift purchases are non-refundable once sent, consistent with the credits refund policy in Section 6 above (and, for gifts purchased via the iOS app, subject to Apple's own refund process described in Section 7).
The Moments feature allows you to keep a private journal of parenting notes, memories, and milestone photos. Journal entries are protected by a PIN you create and are never shared with any third party. Text you write in the Moments journal is never sent to Anthropic — it is completely separate from Clare's AI question-and-answer system.
Photos attached to journal entries — including photos attached while checking off a milestone — are stored as part of your Moments content and are subject to the same PIN protection.
You are solely responsible for the content you store in Moments. JQuant Labs is not liable for any loss, corruption, or unauthorised access to journal entries. We recommend maintaining the security of your PIN and not reusing it elsewhere. A forgotten PIN cannot be reset without losing access to your Moments entries.
Because Moments is a private PIN-protected journal, we are not responsible for the nature of what you choose to record there. We do recommend treating your PIN seriously and not sharing it with others.
Clare awards Hearts as a recognition system when you use Clare's features — for example, reaching a milestone, logging a growth entry, or adding a Moment. Hearts are displayed in your account and are for engagement purposes only. They have no monetary value, cannot be exchanged, transferred, or redeemed, and do not accumulate into credits or any other form of consideration. Hearts are forfeited on account deletion.
If you grant Clare permission to send push notifications, Clare may notify you about milestones and other in-app events. You can withdraw notification permission at any time through your device's Settings. We do not send marketing or promotional notifications without your separate consent.
You agree not to use Clare to:
Clare's software, design, knowledge base curation, and brand are owned by JQuant Labs. The underlying research articles referenced by Clare remain the property of their respective publishers and authors. You may use Clare's answers for personal, non-commercial purposes only.
Clare is provided "as is" without warranties of any kind. We do not guarantee that Clare's answers are complete, accurate, or current. Research evolves — always verify important health decisions with a qualified professional.
To the fullest extent permitted by law, JQuant Labs shall not be liable for any indirect, incidental, or consequential damages arising from your use of Clare, including but not limited to reliance on Clare's answers for medical decisions.
With respect to the Moments journal feature, JQuant Labs is not liable for any loss, corruption, or unauthorised access to journal entries. The Moments feature is provided as a convenience tool. You use it at your own risk and are solely responsible for any content you choose to store. We recommend not using Moments as your sole record of important information.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to your subscription credits until the period ends, after which your account reverts to the free tier.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Continued use of Clare after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Any disputes shall be resolved in the courts of Ontario.
If you are a resident of the United States, applicable US federal and state laws may also apply to your use of Clare — including the California Consumer Privacy Act (CCPA/CPRA) if you are a California resident. Nothing in these Terms limits any rights you may have under applicable US law. For details of your US privacy rights, see Section 9 of our Privacy Policy.
If you are a resident of Quebec, Quebec's Act respecting the protection of personal information in the private sector (Law 25) applies to your use of Clare in addition to federal PIPEDA requirements.
